In the name of God, Amen. I John Smoot, being weak and
infirm in body, but in a perfect state of mind, do ordain this to be my last will and testament,
so help me God. I will and bequeath all my estate both real and personal to my wife Margaret
during her natural life and Elias Murphey can agree to continue farming together as myself and
Elias Murphey are now farming, but if they cannot agree to farm upon the terms we are now farming,
then I will and bequeath to Elias Murphey the lot of land formerly leased to George Pursell forever,
and the balance of my property both real and personal to my wife Margaret. If the said Elias Murphey
and my wife agree to farm as we are now farming during the life of my wife, then I will all of my
land after the death of my wife to Elias Murphey, giving my personal estate to my wife forever.
In testimony I have hereto set my hand and affixed my seal this 25
th
day of July 1839.

This last will and testament of John Smoot deceased was proved
in open court by the oaths of James Heaton and William Mills two of the subscribing witnesses thereto
and ordered to be recorded.
