Barton Smoot’s Will    |

       October the 18th day in the year 1843, I Barton Smoot being of sound mind and memory, thanks be to God for the same. Being well stricken in years and very frail in body, being apprised of the shortness of life and the certainty of death make this as my last will and testament in writing and hereby reverse all former wills.

Item. I give and bequeath unto my beloved wife Sarah all my land and stock and everything else that I own to have and to hold as her own so long as she lives.
Item. I give and bequeath unto my daughter Abigail one feather bed and bedding and no more, which she has received.
Item. I give and bequeath unto my daughter Nancy one feather bed and bedding and no more, which she has received.
Item. I give and bequeath unto my daughter Rosy one feather bed and bedding and no more, which she has received.
Item. I give and bequeath unto my son Coleman one horse which he has received and to have no more.
Item. I give and bequeath unto my son George one horse which he has received and to have no more.
Item. I give and bequeath unto my son John one horse which he has received and to have no more.
Item. I give and bequeath unto my daughter Elizabeth one feather bed and bedding which she has received, and to have no more.
Item. I give and bequeath unto my son Reuben one horse which he has received and to have no more.
Item. I give and bequeath unto my daughter Mary one feather bed and bedding which she has received, and to have no more.
Item. I give and bequeath unto my daughter Cinthia one feather bed and bedding which she has received, and to have no more.
Item. I give and bequeath that my son Charles shall have all my land at my wife’s death if he takes care of me and her till our death.

In witness whereunto I set my name and affix my seal the day and date above written.

At a court held for Fleming County on the 15th day of December 1843.
This writing purporting to be the last will and testament of Barton Smoot decd was produced in court and proved by the oaths of J.B. Phelps and Sarah Fauns, subscribing witnesses thereto to be the will of said Barton Smoot decd and ordered to be recorded which is done.
